End-User License Agreement (EULA) for University of Jos Institutional Repository Purpose: The University of Jos Institutional Repository is an online platform for collecting, preserving and disseminating the scholarly and academic output of the University community (faculty, students, and staff). Its purpose is to provide open access to research and educational materials (e.g. theses, dissertations, articles, datasets) in digital form. Users may access and use the Repository for academic, research, and personal study purposes only. No commercial use of the Repository or its content is intended or authorized; the Repository is offered for the non-commercial advancement of scholarship. Acceptable Use • Permitted Activities: Users may search, browse, download, and print Repository content for their own personal, academic, or educational use. For example, faculty, students, and researchers may reuse content in their teaching, scholarship, or private study – provided they follow any applicable license terms (e.g. giving proper attribution) and comply with copyright law. • Research & Education: The Repository materials are intended to support research and education. Users are encouraged to cite and build upon open-access content under the terms of its Creative Commons license, and to contribute their own work as appropriate. • User Responsibilities: In using the Repository, you agree to respect all license and copyright notices on each item. You must not remove or alter any copyright or attribution notice from downloaded content. You must also refrain from any prohibited activities (e.g. infringement, hacking, or any use that violates Nigerian law) while accessing or using the Repository. Intellectual Property and Licensing All materials in the Repository remain the copyright property of their creators or rights holders unless explicitly stated otherwise. By default, works are published under open licenses. In particular, the University of Jos encourages authors to make their works available under Creative Commons licenses. For example, many works are licensed under a CC-BY 4.0 license (allowing reuse with attribution) or other CC variants. The author or depositor may specify any suitable CC license (including CC0/public domain) to indicate how the work may be shared. Users must comply strictly with the terms of each item’s license: this includes giving proper attribution, not violating any “share-alike” terms, and observing any non-commercial clauses on CC-BY-NC (or similar) works. In all cases, copyright law applies. You may download and use the Repository’s content only within the bounds of copyright and the Creative Commons or other licenses attached to the works. For example, if a work is CC-BY (attribution), you may redistribute it non-commercially provided you credit the author. If a work is CC-BY-NC (non-commercial), you may not use it for commercial purposes. Users are expected to cite sources and to respect any restrictions (for instance, not creating unauthorized derivative works). Restrictions • No Commercial Use: Repository content is not for commercial exploitation. You are prohibited from selling, licensing, or otherwise using any Repository item for profit unless the author or rights holder has given explicit written permission. For instance, you may not compile or redistribute Repository materials as part of a for-profit product or service. Any resale, licensing or commercial redistribution of the content is strictly forbidden. • No Infringement: Do not use the Repository in a way that infringes anyone’s intellectual property or other legal rights. Disclaimers Repository “as-is”: The Repository and its contents are provided “as is” and “as available”. The University of Jos makes no warranty regarding the accuracy, completeness, or fitness of any content for any particular purpose. We do not guarantee that the Repository will be uninterrupted or error-free, and we are not liable for any loss or damage (including data loss) arising from its use. For example, the repository administrators disclaim any responsibility if a file is unavailable, corrupted, or out-of-date. Limitation of Liability: To the fullest extent permitted by law, the University of Jos (and its agents) shall not be held liable for any direct or indirect damages resulting from use of the Repository. This includes any issues caused by interruptions, technical failures, or inaccuracies in the content. In other words, users accept all risk of using the Repository and acknowledge that the University provides the Repository as a service without guarantee. Governing Law This EULA is governed by the laws of the Federal Republic of Nigeria. Any dispute arising under or in connection with these terms will be subject to the exclusive jurisdiction of the Nigerian courts. By using the Repository, you consent to Nigerian law as governing any legal issues.
